4. Shipping, Logistics & Delivery Disclaimer

1. All domestic US transit times released by our logistics partner SwiftUS Domestic are estimated lead times only, not legally binding delivery guarantees. Delays caused by extreme weather, natural disasters, federal holidays, carrier backlogs, customs inspection, incorrect recipient addresses, strikes and other force majeure events are beyond our control, and NixHerb will not compensate for indirect losses such as missed events or time costs arising from delays.
2. Once goods are handed over to the designated logistics carrier, the risk of loss, damage or theft of packages transfers to you as the buyer. We will provide tracking support and assist in filing claims with carriers, but we are not liable for full or partial loss of packages during transportation.
3. Additional remote surcharges apply to Alaska and Hawaii shipments; expedited 2-Day and Next-Day shipping services are unavailable for these two regions, and we do not guarantee transit speed for overseas territories.

5. Intellectual Property Statement

1. All trademarks, logos, texts, graphic designs, product pictures, webpage layout, copywriting, video and audio content on the Platform are the exclusive intellectual property of NixHerb or our authorized licensors, protected by U.S. federal copyright, trademark laws and international intellectual property treaties.
2. Without our prior written authorization, no individual or entity may copy, reproduce, modify, distribute, resell, capture screenshots, crawl, reprint or commercially use any intellectual property content on the Platform. Unauthorized infringement shall constitute a violation of relevant laws, and we reserve the right to pursue all legal remedies including compensation for economic losses.
3. Shopify trademarks, logos and related brand elements belong to Shopify Inc., and other third-party trademarks displayed on the Platform belong to their respective owners. No content on this Platform grants you any intellectual property license implicitly or explicitly.

6. Prohibited Use & User Conduct Disclaimer

1. You may only use the Platform for personal, non-commercial lawful shopping. You are prohibited from using the Platform for fraud, counterfeit transactions, scraping data, automated bot crawling, malicious order placement, credit card fraud, harassment, infringement, illegal resale or any activities violating U.S. federal, state and local laws.
2. If we detect abnormal, malicious or illegal account behavior, we reserve the right to cancel orders, freeze accounts, refuse follow-up purchases and report relevant illegal acts to law enforcement authorities without prior notice. We shall not refund orders generated through improper or prohibited conduct.

7. Limitation of Liability

1. NixHerb, our staff, affiliates, suppliers, logistics partners and Shopify Inc. shall not be liable for any indirect, consequential, incidental, special or punitive damages, including lost profits, lost income, opportunity cost, mental distress, data loss or reputational damage, arising out of your access or purchase of products on the Platform.
2. Our total aggregate liability for all claims related to your orders shall not exceed the actual amount you paid for the disputed goods.
3. Some U.S. states do not allow the exclusion of implied warranties or limitation of consequential damages, so some liability limitation clauses herein may not fully apply to you.
